INTRODUCTION OF INDIAN PENAL CODE
Indian Penal Code (IPC) is India’s official criminal code. It is a complete code that aims to cover all the important aspects of criminal law. The code was compiled by the recommendations of India’s first legal commission established in 1834 under the Charter Act of 1833 under the chairmanship of King Thomas Babington Macaulay. ] It came into operation in British India during the early British occupation of 1862. However, it did not operate automatically in the provinces of Princely, which had its own courts and legal systems until the 1940’s. This Code has been amended several times and is now being supplemented with other criminal provisions.

After the partition of the British Empire, the Indian Penal Code acquired inheritances in the following countries, the Dominion of India and the Dominion of Pakistan, where it proceeded independently as the Pakistan Penal Code. After the separation of Bangladesh and Pakistan, the code continued to apply there. The Code was also adopted by British colonial authorities in Colonial Burma, Ceylon (modern-day Sri Lanka), Straits Settlements (now part of Malaysia), Singapore and Brunei, and is still the basis for criminal codes in those countries.
HISTORY OF INDIAN PENAL CODE
The text of the Indian Penal Code was prepared by the First Law Commission, headed by Thomas Babington Macaulay in 1834 and sent to the Governor-General of the Council of India in 1835. Based on the simplified formulation of English law at the time, the elements were also derived from the Napoleonic Code and Edward Livingston’s Louisiana Civil Code of 1825. The first draft of the Indian Penal Code was sent to the Indian Governor-General of the Council in 1837, but the text was revised. The writing was completed in 1850 and this Code was introduced to the Legislature in 1856, but it did not take its place in the canon of British India until a later generation, following the Indian Revolution in 1857. A careful review at the hands of Barnes Peacock, who later became the first Chief Justice of the Calcutta Supreme Court, and pre-judges of the Calcutta High Court, who were members of the Legislative Council, was legally adopted on October 6, 1860. [4] This Code came into effect on January 1, 1862. Macaulay did not survive the writing of the code he wrote, having died in late 1859. This code came into effect in Jammu and Kashmir on October 31, 2019, as a result of the Jammu and Kashmir Reorganization Act, 2019, and replaced the Ranbir Penal Code of the state.
OBJECTIVES OF INDIAN PENAL CODE
The purpose of this Act is to provide for the general code of India. [6] Although not the first intention, the law does not remove the punitive laws that were in force when they first took effect in India. This is because this Code does not contain all the cases and it is possible that some cases may have been left out of the Code, which was not intended to be exempt from the consequences of punishment. Although this Code covers all the laws in this regard and is limited to matters that reflect the law, there have been many other disciplinary procedures that further regulate the various cases in this code.
